Stallholder Terms & Conditions 2025
CHEESEFEST 2025 STALLHOLDER TERMS AND CONDITIONS
Event Dates: 18 & 19 October 2025
Location: Rundle Park / Kadlitpina, Adelaide, South Australia

1. Participation and Payment
1.1. Participation is confirmed upon acceptance by CheeseFest Australia Pty Ltd and receipt of any required upfront administrative or council licensing fees.
1.2. Stallholders are charged on a commission basis, calculated on the size and location of their stall. All stallholders will receive a tax invoice within seven (7) days after the event for the agreed commission, plus GST.
1.3. All payments must be made in Australian Dollars (AUD) to CheeseFest Australia Pty Ltd by the date specified on the invoice.
1.4. Stall fees cover only the inclusions outlined by CheeseFest. Stallholders are responsible for all additional costs including staffing, transport, equipment hire, accommodation, and other operational expenses.
2. Cancellation and Refunds
2.1. Cancellations must be submitted in writing to CheeseFest Australia no later than 30 days before the event.
2.2. Any upfront administrative or licensing fees are non-refundable.
2.3. If a cancellation occurs within 30 days of the event, CheeseFest reserves the right to retain all payments made and charge a cancellation fee of $1250 AUD.
2.4. In the event of event cancellation or rescheduling due to circumstances beyond CheeseFest's control, CheeseFest will refund any recoverable fees but is not liable for any additional losses incurred by the stallholder.
3. Stallholder Obligations
3.1. Stallholders must maintain a clean, professional, and safe presentation of their stall throughout the event.
3.2. Stallholders must comply with all local council and health regulations, including food handling and safety requirements.
3.3. Any disruptive behaviour or damage to the event site may result in immediate removal without refund and exclusion from future events.
3.4. Stallholders must operate during all event hours and may not dismantle or vacate early without prior written approval.
4. Insurance and Liability
4.1. Stallholders are responsible for their own public liability, product, and business insurance. Proof of adequate insurance coverage may be requested.
4.2. CheeseFest Australia Pty Ltd accepts no liability for loss, theft, damage, or injury incurred before, during, or after the event.
4.3. Stallholders agree to indemnify and hold harmless CheeseFest Australia Pty Ltd from any claims arising from their participation, including product liability, accidents, or regulatory breaches.
4.2 Responsible Service of Alcohol (RSA) and Insurance
4.2.1. Stallholders intending to serve or sell alcohol must hold a valid liquor licence and ensure that all staff have completed Responsible Service of Alcohol (RSA) training, in accordance with South Australian legislation.
4.2.2. Proof of RSA certification and a current liquor licence must be provided to CheeseFest Australia Pty Ltd prior to the event.
4.2.3. Stallholders are responsible for complying with all liquor licensing laws and conditions, including age verification and responsible service practices.
4.2.4. Stallholders serving alcohol must hold appropriate liquor liability insurance and include a copy of this certificate with their general public liability coverage.
4.2.5. CheeseFest Australia Pty Ltd reserves the right to suspend or terminate alcohol service by any stallholder found to be in breach of RSA laws or failing to provide adequate documentation.
5. Marketing and Promotion
5.1. By participating, stallholders agree to allow CheeseFest to use their business name, logo, and promotional materials for marketing and publicity in digital and print formats.
5.2. Any third-party promotions involving CheeseFest must be approved in writing prior to distribution.
6. Force Majeure
6.1. CheeseFest Australia Pty Ltd shall not be liable for any failure to perform or delay due to events beyond reasonable control including but not limited to natural disasters, public health emergencies, or government restrictions.
7. Dispute Resolution
7.1. Any disputes will be resolved through negotiation in the first instance. If unresolved, both parties agree to pursue mediation before any legal proceedings.
7.2. This agreement is governed by the laws of South Australia.
8. Agreement
By confirming your participation via our Google form, you acknowledge and agree to these Terms and Conditions. Your submission of the post-event report and participation in CheeseFest 2025 constitutes a binding agreement.
